Limited Warranty for INDASA Tools
IMPORTANT: Just in case your newly purchased E-Series tool needs to be serviced, please keep the original packaging materials and original receipt.
The INDASA – Indústria de Abrasivos, S.A. (“INDASA”) warrants to its Customers that all E-Series tools commercialized by INDASA under INDASA brands will be free from defects in manufacturing and material throughout the Warranty Period in the terms set out below.
01 . Warranty Period
The Warranty Period shall commence on the date of purchase of the E-Series power tool from an authorized INDASA distributor, reseller and/or importer (as shown on the original purchase receipt) and ends 12 (twelve) months after date of purchase, unless a longer warranty period results from mandatory provision of law of the country in which the E-Series tool was purchased by the Customer.
However, the Warranty Period of E-Series PRO X tools may be extended, free of change, to 36 (thirty-six) months after date of purchase, subject to the following:
a) Customer registers the E-Series PRO X tool with INDASA within 30 days from the date of purchase through the dedicated form accessed through the QR Code found inside the packaging of each E-Series PRO X tool or through our website www.indasa-abrasives.com; and
b) Customer abides by the terms and conditions stated at the beginning of the Warranty Registration form referred in a) above.
Proof of registration of the E-Series PRO X tool must be kept by the Customer in order to benefit from the warranty extension.
02 . Claim for defect
Any claim for defect in manufacturing or material of the E-Series power tool must be made within the Warranty Period and for such purpose the Customer shall deliver the tool (at the Customer’s risk and cost) and present a written warranty claim to the INDASA affiliate company, authorized INDASA distributor, reseller and/or importer from which the tool was purchased, detailing the reason for non-conformity of the tool, such warranty claim must be accompanied by the proof of purchase, clearly indicating the date of purchase and, when applicable, the registration of the E-Series PRO X referred to in Clause 2a) above.
03 . Non-Conformity
In the event of a non-conformity with the warranty, which is accepted by INDASA, the latter shall, subject to the Warranty terms established herein, at its sole discretion and cost, either: (i) repair the defective tool or part or (ii) replace the tool with a like product.
04 . Warranty Repairs
Warranty repairs are carried out solely by INDASA-authorised repair centers and in the event of repair or replacement of E-Series power tool or any part thereof under the terms of this Warranty, this Warranty shall not be extended and will apply to the repaired and/or replacement tool for the remainder of the original Warranty Period.
05 . Manufacture’s Warranty
The manufacture’s Warranty granted by INDASA relates to the characteristics of the Tool at the time of delivery to the Customer and does not cover and expressly excludes the following:
a) Normal wear and deterioration of the tool, associated with its usage;
b) All spare parts;
c) defects resulting from non-compliance with operating instructions, improper use or storage, inappropriate operating conditions, overload or insufficient servicing or maintenance;
d) damage or wear that indicates continuous heavy strenuous usage of the, particularly constant industrial utilisation with continued above-average Product operation, or that suggests the application of force or damage from external influences (e.g. dropping, impact) or foreign matter (e.g. sand or stones);
e) Damages related with transportation of the tool, after its delivery to the Customer;
f) Tools in which non-original INDASA E-Series accessories and/or repair spare parts have been integrated;
g) Tools in respect of which repairs or other modifications, additions, alterations or dismantling have been carried out by the Customer and/or by repair workshops that are not authorised by INDASA.
h) Minor deviations of the tools which do not affect its value and functionality;
i) Tools which have failed to be serviced according to the operating manual;
j) Defects in respect of accessories included within standard deliveries of the tools;
k) Rigid boxes and INDASA samples and merchandising items.
06 . Customer’s sole and Exclusive Remedy
The Customer’s sole and exclusive remedy for warranty claims is the correction of the defect in the terms established herein. To the maximum extent permitted by law , INDASA shall not be liable for any other type of damage or claim, of any nature, or for any indirect, special or consequential loss or damage or, for any loss of profit or other economic loss, all of which are hereby expressly excluded.
07 . Changes in Warranty Terms and Conditions
Only INDASA has the right to change these Warranty Terms and Conditions, without prejudice to the warranty terms granted for tools that have already been purchased.
08 . Rights and Obligations
All rights and obligations arising from this Warranty are governed by and interpreted exclusively in accordance with Portuguese laws, excluding the United Nations Convention on Agreements concerning the International Sale of Goods. This choice of law shall not prejudice any mandatory provision of the law of the country in which the E-Series tool was purchased by the Customer.
09 . Disputes
All disputes arising from or related to this Warranty are to be submitted to the non-exclusive jurisdiction of the courts of Portugal, unless established otherwise by mandatory provision the law of the country in which the E-Series tool was purchased by the Customer.
